This webinar will discuss the latest developments on the PTAB’s use of discretionary denials. We will cover the USPTO’s Request for Comments to enact rules outlined in its discretionary denial precedential decisions and the reaction from industry. We will also discuss recent cases involving discretionary denials in the pharmaceutical and technology spaces and how they might impact IPRs and litigation going forward.

Speakers

Gregory Morris is the Leader of Honigman's Life Sciences Intellectual Property Litigation Practice Group. He holds a Ph.D. in Organic Chemistry from Northwestern University. Gregory’s practice focuses on pharmaceutical, biotechnology, and medical device patent litigation. He has extensive experience representing top pharmaceutical clients on the brand-side in Hatch-Waxman litigation. Gregory also regularly litigates inter partes review (IPR) proceedings before the US Patent and Trademark Office (USPTO). He co-led a team of attorneys who represented a pharmaceutical company in the first-ever successful defense of an Orange Book-listed patent in an IPR review. [Read More]
