The PTAB’s Motion to Amend Pilot Program was launched in March of 2019 and offered a more robust opportunity for amendment to patent owners during AIA trials. Sam and Theodoros will describe the mechanics associated with the motions to amend under the Pilot Program, including recent updates and examples. They will also discuss important strategic considerations for both petitioners and patent owners, such as protective orders, effects of joinder, effects on stays and intervening rights, and alternatives to motion to amend practice.
