Current Trends and Strategic Considerations in Post-Grant Challenges to Biologics Patents

Our presentation analyzes key developments and strategic considerations in post grant challenges to biologics patents from 2012, the inception of the PTAB, to the end of 2025. We will present data from two recent papers concerning the 440 IPRs, PGRs, and EPRs filed during this timeframe, including key trends in filings, as well as institution, final, and appellate decisions. We will also provide an overview of recent rule changes in the PTO, particularly changes relating to discretionary denial, and how those rule changes have impacted IPR, PGR, and EPR filing trends and strategy.
